Terms of Reference for The Review of The Lighthouse Terms and Conditions of Service

BACKGROUND

The Lighthouse is a registered public Trust established and mandated to contribute to Malawi’s national response to HIV and AIDS as a model in providing a continuum of high-quality care and building capacity in the health sector. It carries out its mandate through five Centres of Excellence (CoEs) located in Blantyre, Lilongwe, Mzuzu and Zomba and provides leverage for leadership and delivery of integrated HIV prevention, treatment, care, and support services in Malawi. Lighthouse has been involved in the development of locally applicable HIV care and treatment models. It is strategically positioned in Malawi’s National HIV response due to its close collaboration with the Ministry of Health (MoH). The Lighthouse in close coordination with MoH operates integrated services at Kamuzu Central Hospital, Bwaila Hospital, and some health facilities in urban and rural areas in Lilongwe, Queen Elizabeth Central Hospital in Blantyre, Zomba Central Hospital, with support from the United States of America President’s Plan for AIDS Relief (PEPFAR) through a Cooperative Agreement with Centres for Disease Control and Prevention (CDC) through Grant #1NU2GGH002495.

The expected outputs of the program are as follows:

  • Goal 1: Service delivery:to enhance high-quality, integrated HIV prevention, treatment, care and support services for adults and children
  • Goal 2: Model interventions and operations research: to develop, pilot, evaluate, and disseminate innovative programs and policies across the continuum of prevention, treatment, care and support for HIV infection and its co-morbidities, both infectious and non-infectious.
  • Goal 3: Quality Management:to ensure that all patients at Lighthouse clinics and all supported sites are receiving quality health care and services as recommended by the MoH and other health development partners by utilizing quality improvement (QI) methodologies in a multidisciplinary team approach.
  • Goal 4: Capacity strengthening:to build and strengthen healthcare capacity for high quality HIV prevention, treatment, care, and support services.

The dynamics of the national response to HIV and AIDS in Malawi have changed tremendously over the past years. Changes have occurred in the dynamics of the epidemic, new interventions for prevention, care and treatment and that Ministry of Health has mobilized many more partners in different areas of the HIV response and there are more providers of related services than before. Amongst these partners, Lighthouse has grown tremendously within the past few years where the staffing level has significantly moved from one hundred to around five hundred.

In view of these changes, Lighthouse would like to recruit the services of a consultant to perform a comprehensive review of its employment Terms and Conditions of Service within the current context of the Malawi Labor Laws and the standard good human resources management practices.

OBJECTIVE

The objective of this assignment is to review of the Lighthouse’s current Terms and Conditions of Service and align them with the Malawi Labour Laws (in particular, the Employment Act), Malawi Public Service Regulations, the CDC Grant Agreement, and current and emerging human resource management practices in Malawi. Specifically, the review must, among other things, recommend comprehensive rules and procedures, consistent wth the rule of law, to facilitate human resource management in the Lighthouse.

SCOPE OF ASSIGNMENT

The consultant is specifically expected to

  1. Conduct extensive consultations with Lighthouse Management, other members of staff, the Lighthouse Board of Trustees, Ministry of Health and the Department of Human Resource Management and Development.
  2. Review and analyze the current Lighthouse’s Terms and Conditions of Service and provide a status report.
  3. Present the status report to Lighthouse staff to generate clear understanding of the current legislation and other standard provisions and areas requiring improvement.
  4. Revise the current Terms and conditions of service in keeping with prevailing legal provisions, relevant human resource management frameworks of similar organizations and relevant current and emerging standard/best practices in human resource management and development.
  5. Review Lighthouse contracts to ensure they are aligned to current labour laws and the revised terms and conditions of service.
  6. Draft a Code of Ethics as an integral part of the revised the Terms and Conditions of Service.

DELIVERABLES

The following deliverables are expected from the consultant:

  1. A clear inception report on the approach and methodology to be used.
  2. A status report detailing shortfalls in the current terms and conditions of service and outlining clearly areas for improvement with verifiable justification.
  3. Acceptable draft revised / new Lighthouse Terms and Conditions of Service.
  4. Final manual of the new Lighthouse Terms and Conditions of Service.

QUALIFICATIONS/EXPERIENCE/SKILLS REQUIRED FOR THE CONSULTANT

This assignment requires services of an individual who should meet the following minimum requirements

  • a master’s degree in business administration, public administration, and human resources management. Possession of a law degree (preferably with a bias for labour or contractual law) will be an added advantage.
  • At least 10 years of work experience in the field of human resources management.
  • Experience in conducting similar reviews for not less than three organizations in the past five years with traceable referees and documentary evidence.
  • Ability to render consulting services in the most professional, effective, and efficient manner.
  • Excellent report writing skills.

DURATION OF THE ASSIGNMENT

The whole assignment is expected to take a maximum 15 Calendar days, with no time extension.

REPORTING

The consultant will report to the Lighthouse Executive Director. The Director of Administration will be responsible for the day-to-day management of the process. The Lighthouse Board of Trustees will ultimately be responsible for acceptance of the final product.
